Patent Interference Decision Reaffirmed at Federal Circuit

On March 9, 2016, the United States Court of Appeals for the Federal Circuit (Federal Circuit) affirmed a decision of the United States Patent and Trademark Office, Patent Trial and Appeal Board, thus confirming that inventorship of several patents owned by Jodi A. Schwendimann and licensed to NuCoat, Inc. relating to the heat transfer of images or other indicia to textiles, particularly dark-colored textiles, correctly lies with Ms. Schwendimann and her co-inventors.  Arkwright Advanced Coating, Inc. (AACI) had initiated what is referred to as an interference proceeding, challenging inventorship of these patents, in the fall of 2013.  The recent decision by the Federal Circuit markedly resolves this two-and-a-half year challenge in favor of Ms. Schwendimann, shutting down each and every argument that AACI raised on appeal.
